Ballot Order

Plaintiffs affiliated with the Democratic Party may pursue their claims challenging the placement of party candidates on election ballots based on the number of votes from previous elections, a federal court in West Virginia ruled, finding that the ballot order may burden plaintiffs’ First and Fourteenth Amendment rights.
