RICHMOND, Va. (CN) - Lorillard Tobacco has accused a competitor of copying its style in advertisements for the Bailey's brand of menthol cigarettes. Lorillard says S&M Brands swiped its Newport font and formatting in Bailey's print ads.
"Like Lorillard, Defendant has prominently used the Newport stylized mark, depicted in orange Cooper font on a green background," the lawsuit claims. "Defendant has even gone so far as to partially obscure the Newport stylized mark, in the manner of Lorillard's own advertising."
The lawsuit includes images of the allegedly infringing ads.
The plaintiff is represented in Federal Court by Kristen Calleja with McGuirewoods LLP.
