Bag Maker Tells Rival to Back Off ‘Green Bags’

HOUSTON (CN) - Evert Fresh, maker of produce-preserving "Green Bags," has accused a competitor of infringing on the trademarked name. Texas-based Evert Fresh claims it has been the rightful owner of the Green Bags trademark and trade dress since June 2000.

In its lawsuit in Federal Court, Evert Fresh says Starcrest Products of California knowingly advertised, sold and distributed storage bags bearing the same green color and a confusingly similar mark as Evert Fresh bags.

The bags are allegedly sold on the same market.

Represented by Richard Redano with Duane Morris, the plaintiff seeks damages for unfair competition.
