Bag Charges

The Second Circuit ruled that a lower court improperly dismissed passengers’ claims relating to Spirit Airlines’ carry-on bag charges. 

NEW YORK – The Second Circuit ruled that a lower court improperly dismissed passengers’ claims relating to Spirit Airlines’ carry-on bag charges. 

The “carriage contract” was ambiguous and the claim is not preempted by the Airline Deregulation Act.
