SAN DIEGO (CN) - After changing into a Barbie outfit in the men's restroom, a Big Lots customer snuck into the women's restroom and sexually assaulted another customer, the woman claims in court.
Jane Doe sued Big Lots Stores and Gregory P. Schwartz on Nov. 24 in Superior Court.
She claims that Schwartz took a Barbie costume from the shelves and took it into the men's room, where he changed into it. Then, dressed as Barbie, he "walked into the women's bathroom where he hid in one of the stalls," according to the lawsuit.
She entered the restroom and was "was physically and sexually assaulted by Gregory Schwartz, who was hiding in the stall adjacent to plaintiff," Doe says.
She says the store's security system should have seen Schwartz before and after he entered and left the men's room.
She seeks damages for negligent supervision, sexual battery and emotional distress.
She is represented by Dimetri Reyzin.
"I have never handled a case like this before," Deputy District Attorney Mary-Ellen Barrett told NBC News after Schwartz was arrested.Doe says the incident happened on Feb. 28
