SAN FRANCISCO (CN) - Artist Berenice Brackett says she denied Kevin Barry Fine Art Associates' request to mass produce and sell copies of her painting and limited-edition prints, but he did it anyway, making tiny changes to them, and sold at least 934 of them to Hilton Hotels, which Hilton displays on its Internet ads.
Brackett demands punitive damages for interference and copyright violations, an accounting, disgorgement of unjust profits and destruction of the offending pieces.
Brackett lives in Sonoma County. Barry operates out of Los Angeles. She claims the defendants illegitimately copied and are displaying at least three of her paintings: "Falling Into Place," "Winter's Velvet," and "Great Expectations."
Brackett is represented in Federal Court by Marc Bernstein.
