BOSTON — In a case it called “challenging” and “sad,” the First Circuit upheld the dismissal of a man’s claims that the Massachusetts Army National Guard negligently fired military artillery close to him while he walked through Boston Common, allegedly causing him to suffer permanent hearing damage.
