Army Corps Can Bundle Contract Requirements

WASHINGTON (CN) - The Court of Federal Claims dismissed a small construction company's bid to stop the Army Corps of Engineers from bundling its military contract requirements and effectively blocking small businesses from the bidding process.

Tyler Construction Group claimed that the Army Corps illegally settled on an "indefinite delivery/indefinite quantity" contract for the design and construction of military buildings in the southeast United States.

According to the ruling, Tyler Construction argued that such a large-scale contract "violates a statutory prohibition against consolidating projects that would otherwise be available for competitive award to small business concerns.

Judge Wiese found that the Corps' decision to award the contract on a sequenced, single-project basis was "lawful and well-informed."
