ZONING - Arizona challenged the dismissal of misdemeanor charges against two sexually oriented businesses that sold adult magazines. J. Irvine cited studies showing that bans on night-operated adult businesses decrease secondary effects such as property crimes, illicit drug use and prostitution. Thus, there is a sufficient connection between the regulated speech and the secondary effects. See ruling.

PRIVACY - The Suggestion Box, an email service provider, challenged a discovery order for the identity of a Suggestion Box email account holder who sent an anonymous email to Mobilisa employees. J. Timmer found that the trial court failed to consider whether Mobilisa's interests in disclosure outweigh the speaker's privacy interests. Remanded. See ruling.
