Appeals Court Nixes Habitat Classification

SAN FRANCISCO (CN) - The California Coastal Act does not empower the California Coastal Commission to declare property near Monterey Bay an "environmentally sensitive habitat area" during an appeal of a local government's decision to grant a coastal development permit, a state appeals court ruled.
