Appeal Over Gas Terminal Isn’t Ripe For Review

BOSTON (CN) - The First Circuit refused to block a plan by Weaver's Cove Energy to build a liquefied natural gas terminal and pipeline in Fall River, Mass., saying its conditioned approval is not ripe for review.

The city, the attorneys general of Massachusetts and Rhode Island, the Conservation Law Foundation and Michael Miozza argued that the Federal Energy Regulatory Commission should not have approved the terminal and pipeline until serious environmental issue had been addressed.

Because the U.S. Coast Guard and the Department of the Interior have not completed their evaluations of the project, "it would be premature to address the merits of the appeal," Judge Torruella wrote. See ruling in City of Fall River v. FERC.
