LINCOLN, Neb. — The Nebraska Supreme Court reversed a lower court’s judgment in favor of an apartment building owner who maintained a balcony where a man fell while leaning against the rail. The record shows that the owner knew the balcony was used as a smoking lounge and had previously planned to fix the railing, but never actually did so.
