Another Debt Collector Accused|of Creating Defamatory Web Site

PHOENIX (CN) - In what may be an emerging trend, an auto finance company is accused of defaming a woman by creating a Web site using her name and posting on it that she "isn't paying for her Cavalier!" The woman says the Auto Financing Network also repossessed her car illegally by hiding a GPS device in it.

Plaintiff Jennifer Dicks disputes the debt. She says the defendants "created a Web site using Plaintiff's name. The Web site www.jenniferdicks.com was created. The title of this Web states 'Jennifer Dicks isn't paying for her Cavalier!'

"The content of this Web site is the same content on Defendant's Web site for the

Business Auto Financing Network, Inc."

Dicks also sued Michael Fisher.

This is the second recent complaint in which a consumer complains that a debt collector created a defamatory Web site.

Dicks demands damages for defamation, privacy invasion, consumer fraud, emotional distress, negligence and breach of contract. She is represented in Maricopa County Court by David McGlothlin with Hyde & Swigart.
