AmMed Says Rival Tried to Swipe Its Patients

NASHVILLE (CN) - Medco Health Solutions and subsidiary Liberty Medical Supply tried to poach AmMed Direct's diabetes patients in Tennessee by falsely telling them that the company is going out of business, AmMed claims in Federal Court.

AmMed delivers diabetes testing supplies, products and medications directly to the homes of diabetes patients nationwide. Medco Health Solutions does the same through Liberty Medical Supply.

The plaintiff accuses Liberty representatives of calling its customers in Tennessee and telling them that: "AmMed is no longer shipping supplies," "AmMed is bankrupt," "Liberty purchased AmMed," and "AmMed is turning off its phones for good in March," among other lies.

AmMed says it called Liberty's assistant vice president for compliance in August 2008 after receiving complaints from customers who were worried that AmMed would not be able to provide the life-saving medicine they needed. Liberty representatives have allegedly continued to spread lies and misinformation that damage AmMed's reputation.

The plaintiff seeks an injunction preventing the defendants from contacting its customers, plus actual and punitive damages.
