Amazon worker exempt from arbitration

DALLAS — A federal court in Texas denied Amazon’s motion to compel arbitration in a former “sortation associate’s” personal injury lawsuit claiming the corporation is liable for another employee dropping a package on her head. Though there is an arbitration agreement between the parties, warehouse workers qualify as “transportation workers” under the Federal Arbitration Act because they “have a ‘direct and necessary role’ in the transportation of goods across borders” and are therefore “engaged in foreign or interstate commerce,” so they are exempt from the Act.
