Airman Accuses Best Buy of Invading Privacy

PHILADELPHIA (CN) - A Best Buy employee shared a female airman's private, sexually explicit photo on the Internet while transferring data between cellphones, she claims in court.

Megan Munoz says she had gone to a Best Buy near her home in Bordentown, N.J., on Dec. 26, 2012, to buy a cellphone.

The employee who was helping with the sale allegedly agreed to transfer data from Munoz's old cellphone to the new one.

Munoz says the employee asked her to leave both phones with him for 30 minutes so he could complete the transfer.

She allegedly took the suggestion to visit some other stores in the Moorestown mall and then returned for her phone.

While she was gone, however, the customer service representative "viewed a personal, private photograph of an explicit sexual nature on plaintiff's cellular phone and transferred it without plaintiff's permission," according to the complaint in the Philadelphia County Court of Common Pleas.

Munoz says an unknown number of recipients saw the image before it was posted on Dec. 28, 2012, to Tumblr and other social media websites.

"On Dec. 31, 2012, plaintiff was advised by her employer, the United States Air Force, that a sexually explicit photograph has been posted on military-dedicated pages of the Tumblr website," according to the complaint.

Munoz says the photo was intended for her husband and she had never shared it with anyone else.

It is impossible to know how many people have received or viewed the picture, according to the complaint.

Munoz claims the incident caused her severe emotional distress, anxiety and depression.

She seeks damages from Best Buy and BBY Solutions, alleging negligence, emotional distress and invasion of privacy.

Munoz is represented by Dana Klayman Weitz with Master Weinstein Schatz Moyer.

In a similar lawsuit against Best Buy in August, an Alabama student claimed that a member of their Geek Squad posted her nude photos on the Internet after working on her computer.

Best Buy could not be reached for comment Monday after business hours.
