WASHINGTON (CN) - The Department of Labor has proposed an overhaul of the rules of practice and procedure for administrative hearings before Labor's Office of Administrative Law Judges (OALJ).
The department expects the current trend of increasing whistleblower and other workplace retaliation claims to continue, requiring advanced rules to deal with the complexities, according to the proposal.
These types of cases require more structured management and oversight by the presiding administrative law judge and more sophisticated motions and discovery procedures than the current regulations provide, the proposal says.
Labor is seeking comments by Feb. 4, 2013.
