Ad Men Say Dr. J Swiped Idea

LAS VEGAS (CN) - A pair of ad men say NBA star Julius Erving swiped their idea for a Dr Pepper television commercial that would feature "Dr. J" and other famous fictional and real-life "doctors."

George Burns and Rodney Junior say they met Irving at a hotel in November 2007 to discuss the idea for the commercial.

The men say Erving expressed interest, and that at his request they sent a business proposal to Erving's assistant.

In February 2008, they say, Erving's assistant told them that Erving would not be able to do the commercials because he was concentrating on a new golf course project.

The men say they learned in August 2008 that Erving was starring in Dr Pepper commercials "very similar to the one proposed by plaintiffs," according to the lawsuit in Clark County Court.Plaintiffs seek punitive damages for breach of contract, theft of trade secrets, unjust enrichment, and fraud or misrepresentation. They are represented by Barry Levinson.
