Actress Says David Spade Swiped Her Show

LOS ANGELES (CN) - "Baywatch Hawaii" actress Krista Allen claims her onetime friend David Spade swiped her idea for a TV show being broadcast as "Fameless," in a demand for $1 million plus punitive damages.

Allen sued Spade in Superior Court on Sept. 25, claiming he agreed to go 50-50 with her in pitching a TV show she called "Frauditions," now being broadcast as "Fameless."

Allen, 44, has appeared on "Days of Our Lives" and in small parts in several movies, including "Liar, Liar" and "Anger Management."

Spade, 51, a "Saturday Night Live" alumnus, is far better known.

Allen claims they met in 2001 or 2002 and "became close friends."

She says she conceived the "Frauditions" show in 2014, in which "participants would be conned into auditioning, performing, and competing in fake television programs," in which actors and celebrities would appear as fake contestants and judges, and "the 'fakes' would engage in increasingly bizarre behavior, thereby generating stunned reactions by the victims of the prank."

Allen claims Spade "loved it" and they agreed to pitch it together, as equal partners, in an "oral partnership agreement."

But Spade's agents at (nonparty) William Morris Endeavor Agency objected to the 50-50 split, because of Spade's "enormous celebrity," so, Allen says, she "tentatively agreed" to a 65-35 split.

Come to find out William Morris was cutting a deal between Spade and the production company, which would kill their partnership agreement, strip her of "created by" credits and other rights, including a role in the show, so she rejected it, Allen says.

Spade then "breached the pre-existing oral partnership agreement by misappropriating the 'Fraudition' prank format and producing it as a television program called 'Fameless,' in which spade appears as the host," Allen says. She adds: "(E)ight episodes of 'Fameless' have been produced and are currently being aired."

She seeks more than $1 million, plus punitive damages, for breach of agreement, breach of fiduciary duty, and tortious interference.
