9th Circuit snuffs minors’ class action against EPA

SAN FRANCISCO — The Ninth Circuit upheld a California federal court’s decision to throw out 18 minors’ class action against the Environmental Protection Agency and other government officials for counting dollars today as more valuable than future dollars in a manner that allegedly violates children’s constitutional rights when applied in cost-benefit analyses of greenhouse gas emissions. The kids lack standing and their discrimination theory fails to state a viable injury-in-fact to their equal protection rights. Further amendment would be futile, the appeals court finds.
