9th Circuit Rejects U.S. Appeal in Wiretap Case

(CN) - The 9th Circuit rejected the Obama administration's bid to stop a lawsuit over the government's warrantless wiretapping program. The court issued a one-page order denying the Justice Department's request for an emergency stay.

The Obama administration, like the Bush administration, cited the state-secret privilege in trying to halt a lawsuit brought by the Al-Haramain Islamic Foundation. The government said the litigation could weaken national security.
