9th Circuit

IMMIGRATION - Per curiam, the 9th Circuit remanded a petitioner's asylum application, ordering the immigration judge to apply the Board of Immigration Appeals' recent guidance for when an asylum application may be found frivolous. The board's denial of the petitioner's motion to reopen solely on jurisdictional grounds constitutes an abuse of discretion.
