BANKRUPTCY, REAL ESTATE - The bankruptcy court ruled that the transfer of mortgage interests in the debtor's property to certain lenders were preferential transfers. The 8th Circuit found that a debtor's post-petition refinancing of home mortgages does not impact a trustee's ability to avoid the perfection of the mortgages as preferential transfers. Thus, the trustee was entitled to a judgment against each lender equal to the value of the lender's preferential mortgage.
