CHICAGO (CN) - A Chicago terror suspect's request to review the documents that let the FBI monitor him for months will not face en banc review, the 7th Circuit said Thursday.
Adel Daoud, a U.S. citizen, was indicted in 2012 for attempting to detonate a bomb at a downtown Chicago bar.
Undercover FBI agents posing as terrorists had contacted the 18-year-old Daoud, and he expressed interest in committing violent attacks in the United States, according to the underlying 7th Circuit ruling.
One of his FBI correspondents put Daoud in touch with another undercover agent who met with the teen six times and supplied him with a fake bomb to destroy the target of his choice.
Daoud parked a jeep containing the bomb in front of a bar in downtown Chicago, and tried to detonate the bomb in the presence of the agent, who immediately arrested him.
In court, Daoud's counsel sought access to the classified information that supported the government's warrant applications to the Foreign Intelligence Surveillance Court (FISC) authorizing the electronic surveillance Daoud.
Judges Richard Posner, Michael Kanne and Ilana Rovner were on the three-judge panel that denied this request in June. Today the court declined to reconsider en banc. An opinion may be forthcoming.
