7th Circuit

PROPERTY - The 7th Circuit found that the use of eminent domain was reasonably necessary for Illinois Power, because the use of the canals could not be acquired from the canal company "by contract or pledges." The lower court properly set the eminent domain compensation somewhere between what the canal company asked for and what the power company was willing to pay.
