MONCKS CORNER, S.C. (CN) - A woman claims the Hanes push-up bra she bought at Wal-Mart permanently discolored her skin. She demands $74,999.99 plus punitive damages, and adds that until it happened, she "could not appreciate the danger a Hanes bra posed to her."
Cherrill Bennett says she bought the $10 bra at a Wal-Mart in Goose Creek, and that its straps discolored her skin. She blames the dyes that bled into her skin.
She says the "defendants knew or should have known that the bra was an inherently dangerous product.
Hanes holds itself out as "possessing superior knowledge to that of the plaintiff regarding the safe design and manufacture of the bra," so it should have known, through reasonable inspection, that its bra could or would discolor her skin, she says.
She says the bra discolored her skin in February 2008 and her "skin discoloration is permanent and persists to date."
She seeks damages for negligence, breach of warranty, failure to warn, and strict liability in tort.
The defendants are Hanesbrands, Hanes Corp., Haynes Dye and Finishing Co., and Wal-Mart Stores.
