6th Circuit Nixes Officer’s Breathalyzer Challenge

CINCINNATI (CN) - The 6th Circuit tossed the case of a Nashville police officer who challenged his superiors' decision to give him a breathalyzer test after he got into an off-duty bar fight. The court rejected Officer Joe Pennington's claim that he agreed to take the test only because he feared he would be fired or suspended if he refused. See ruling.
