5th Circuit

GOVERNMENT, DEBT - Wagstaff took out student loans to attend college but never made a voluntary payment on the notes. On first impression, the 5th Circuit ruled that Congress did not waive sovereign immunity by enacting the Fair Debt Collection Practices Act, because Wagstaff cannot point to any language that unequivocally and expressly waives sovereign immunity.
