5th Circuit

INSURANCE - The 5th Circuit ruled that a lawsuit filed by two renters whose possessions were destroyed in Hurricane Katrina is time-barred. The renters took out a renter's policy, but were told they were not eligible for flood insurance because they were not homeowners. The circuit found that they signed a form acknowledging they did not want flood coverage, which directly conflicted with what their insurance agent told them. Thus, the renters should have known about the alleged misrepresentation in 2004, making their 2006 lawsuit untimely. See ruling.
