BELLEVILLE, Ill. (CN) - Walgreens charges an illegal $55 flat fee for copies of health-care provider records, an unhappy customer claims in a class action.
Raymond Griggs says Walgreens charged him a $55 flat fee for a copy of his records. Griggs claims Illinois law allows pharmacies to charges fees that cover only the time and costs of copying, and that the fees not exceed a $24.81 handling charge for processing, 93 cents a page for the first 25 pages, 62 cents a page for the 26th through 50th pages, 31 cents a page for any pages beyond 50, and $1.55 a page for any copies made from microfiche or microfilm, plus actual shipping costs.
"Walgreens charged plaintiff and class a flat fee, which exceeded the statutorily permitted handling charge, cost of copies, and actual shipping charges, when they requested and later received a copy of their Walgreens' pharmacy records," the complaint states.
The class consists of all Illinois residents who were charged the excessive fees by Walgreens. Griggs seeks actual and punitive damages for violations of the Illinois Consumer Fraud and Deceptive Business Practices Act, violations of the Uniform Deceptive Trade Practices Act, fraud and unjust enrichment.
