TRADEMARK - In the 4th Circuit, Louis Vuitton luxury luggage loses its claim that a dog chew toy labeled "Chewy Vuiton" and shaped like a handbag was a trademark infringement.

J. Niemeyer finds that the district court properly held that Haute Diggity Dog's dog toys were successful parodies of Louis Vuitton's trademarks, designs, and products. The dog toys are not likely to cause confusion with Louis Vuitton's products, and the copyright was not infringed. Also, the trademark was not diluted. The toy will not blur the distinctiveness of the famous mark, as Haute Diggity imperfectly adopted the designs. Affirmed. Louis Vuitton v. Haute Diggity Dog
