4th Circuit

ATTORNEY FEES - An environmental coalition brought a citizen suit against Green Valley Coal. The 4th Circuit found that the coalition was properly awarded attorney fees under the Surface Mining Control and Reclamation Act's fee-shifting provision with regard to the preliminary injunction. However, the fee award with respect to the supplemental claims phase should be vacated because it included fees for administrative work. Affirmed in part. See ruling.
