3rd Circuit

ATTORNEY FEES, CONSTITUTION - Plaintiffs successfully challenged the constitutionality of Pittsburgh's ordinance regulating expressive activities in public forums. Pittsburgh then passed a new ordinance that the parties agreed corrected all constitutional problems. The 3rd Circuit held that these circumstances make plaintiffs the "prevailing party," so the attorney-fee award was proper.
