3rd Circuit

ENVIRONMENT - A mining company was issued several health and safety citations regarding a mine ventilation system. The 3rd Circuit found that mere compliance with an approved ventilation plan does not preclude violation of the regulation that requires that plan. The citations were backed by adequate evidence that the ventilation system was not working properly.
