3rd Circuit

TORT - The Warner-Lambert Co. brought an action for damages stemming from cargo that was destroyed when FedEx's plane crashed. The 3rd Circuit held that the indirect carriers were not subject to common-carrier liability, and that all defendants, including FedEx, were not entitled to limited liability because they failed to properly list the site of the crash on their air waybills, as required by the Warsaw Convention.
