2nd Circuit to Reconsider Tribal Immunity Ruling

(CN) - The Supreme Court vacated a decision in the tax dispute between Madison County, N.Y., and the state's Oneida Indian Nation in an unsigned opinion on Monday.

Oneida's attorneys informed the court that the tribe passed a law on Nov. 29, 2010, waiving "its sovereign immunity to enforcement of real property taxation through foreclosure by state, county and local governments within and throughout the United States," the order states.

In light of the development, the Supreme Court directed the 2nd Circuit to consider whether it needs to revisit its ruling on sovereign immunity or address other questions on the issue.
