2nd Circuit

LABOR - The 2nd Circuit held that a staffing agency's refusal to pay overtime wages to nurses who worked for more than 40 hours a week violated federal labor laws. But the government failed to prove that Gotham Registry was in contempt for failing to comply with a consent judgment settling an earlier enforcement action, in which the agency agreed to treat nurses as employees and pay them overtime wages.
