2nd Circuit

IMMIGRATION - The 2nd Circuit upheld dismissal of an immigrant's appeal of a deportation order after he overstayed his visa. The plaintiff failed to substantiate his claim of ineffective assistance against an immigration assistant who is not an attorney. Also, the information that the assistant allegedly left out of the immigrant's application - that the plaintiff has a serious disability - would not have helped him stay in the country.
