1st Circuit: Prosecution of Chinese immigrant not racist

BOSTON — The First Circuit upheld the conviction of a Chinese immigrant for unlawful possession of a trade secret related to microchip information. He argued the government selectively prosecuted him criminally rather than seeking a civil remedy only because he is from China, but he did not convince the court he was “being treated differently from another class, the technology has a “potential military use” and concerns about Chinese involvement of U.S. industry secrets justified law enforcement to look into the tips submitted to the FBI.
