1st Circuit

JURISDICTION - In a lawsuit filed by Kellogg's Puerto Rican distributor challenging the company's decision to let affiliates sell certain products directly to retailers, the 1st Circuit concluded that the Puerto Rico-based Caribbean subsidiary of Kellogg was an indispensable party whose intervention in the lawsuit destroyed diversity of citizenship. Dismissal affirmed.
