11th Circuit to Record Health Care Hearing

ATLANTA (CN) - As the 11th Circuit prepares for a hearing next week on the constitutionality of health care reform, the court issued an order to record the oral arguments for sale.

The ruling Tuesday suspends a ban that the federal appeals court normally applies on recording oral arguments.

To acquire one of "a limited number of CD copies of the oral argument," prospective buyers can pay $26 at the clerk's office on the day of the argument, according to a memo on the court's website.

A three-judge panel composed of Chief Judge Joel Dubina, Judge Frank Hull and Judge Stanley Marcus is set to hear oral arguments at 9:30 a.m. on Wednesday, June 8, in room 338 of the Atlanta courthouse.

On Jan. 31, U.S. District Judge Roger Vinson in Pensacola, Fla., became the second judge to rule against the Patient Protection and Affordable Care Act, which President Barack Obama signed into law last year.

Noting that the so-called individual mandate provision was unconstitutional, Vinson struck down the entire law and issued an injunction that would have stopped the government from implementing measures to fund the law before it goes into effect in 2012.

Vinson stayed his own ruling, however, a little over a month later.

The 4th Circuit in Richmond, Va., heard oral arguments on May 10 related to a Virginia judge's ruling against the law.
