10th Circuit

EMPLOYMENT - The 10th Circuit allowed a former railroad worker to pursue his discrimination claims against the company. He claimed someone wrote the word "nigger" on his locker and a restroom wall, and placed a hangman's noose on a wall clock. The court remanded to determine whether the alleged racist graffiti problem, combined with the company's failure to respond to plaintiff's complaints, contributed to subsequent acts of harassment.
