10th Circuit

     SETTLEMENTS – Water company Dona Ana Mutual Dom entered into a settlement agreement that recognized its exclusive rights to provide water to customers in a northeast portion of Las Cruces, N.M. Another water company disputed the plaintiff’s rights. The 10th Circuit overturned a finding that the competing water company was a third-party beneficiary, because the language of the settlement does not indicate any intent to confer such a benefit.
