SETTLEMENTS - Water company Dona Ana Mutual Dom entered into a settlement agreement that recognized its exclusive rights to provide water to customers in a northeast portion ofLas Cruces,N.M. Another water companydisputed theplaintiff's rights. The 10th Circuitoverturned a finding that the competing water company was a third-party beneficiary, because the language of the settlement does not indicate any intent to confer such a benefit.
