Tenacious D Show Injury Leaves Insurers in a Huff

(CN) - An insurance company that paid more than $1 million to settle a lawsuit from a stagehand who was injured at a Tenacious D concert says American Insurance should have defended the band.

St. Paul Fire and Marine Insurance Company and The American Insurance Company both insured Robotron 5000, a company associated with the rock band Tenacious D, according to the lawsuit in Los Angeles Superior Court.

A stagehand was seriously injured after a concert in November 2006, and sued Robotron.

St. Paul says it spent more than $200,000 defending the band, and $1 million settling the lawsuit on the band's behalf.

American Insurance, on the other hand, allegedly refused to participate in the action and paid nothing.

St. Paul claims American agreed to be the band's primary insurer, and should reimburse the money it spent defending Tenacious D.

St. Paul sued for equitable indemnity, equitable subrogation and equitable contribution.
