Landlady Sues Over Ballplayer Roughhousing

SAN FRANCISCO (CN) - Star baseball pitcher Tim Lincecum smashed or stole everything in his apartment that wasn't nailed down before moving out, his former landlord claims.

Homeowner Mindy Freile and her attorney did not return calls to verify whether they are suing the San Francisco Giants phenomenon who led the team to a 2010 World Series victory.

Tax data says that Freile's single-unit property in San Francisco is worth about $1 million.

Lincecum was supposed to leave the apartment in "broom clean" condition when he moved out in February 2011, according to the complaint in San Francisco County Court.

But when he did vacate, late, he allegedly deserted an apartment in shambles. Lincecum also failed to pay all the rent, according to the complaint.

Freile also claims that Lincecum destroyed her personal property in the apartment and in a storage area.

She wants $350,000 in damages, saying her tenant "broke plaintiff's personal property, desks, stained, defaced, tore, injures or destroyed portions of the subject premises."

Freile also wants Lincecum to return "bedding, doors, carpet, pillows, kitchenware, linens, furniture, household appliances, art work, decorations, patio furniture, lights, lamps, and mirrors, among other things."

Filed days after the Giants lost their shot at the 2011 playoffs, the complaint alleges breach of contract, negligence, misrepresentation, trespass and conversion.

Lincecum was nicknamed "the Freak" for his unusual pitching style. He began playing for the Giants in 2007 and won the Cy Young Award for best pitcher in the National League in 2008 and 2009.

Freile is represented by Jonathan Herschel Bornstein with Bornstein & Bornstein.

A Washington lawyer who represented Lincecum against marijuana charges in 2010 did not return a call for comment.
