(CN) - An Atlanta police sergeant working part-time as a Wal-Mart security guard has been indicted for using excessive force when he broke the leg of a man he wrongly accused of shoplifting.
According to the indictment announced Wednesday, Police Sgt. Trevor King was in uniform on the evening of Oct. 13, 2014, when, while working at a downtown Wal-Mart, he stopped a customer he mistakenly believed had stolen something from the store.
Prosecutors say King grabbed the customer's shirt and began beating him with an expandable baton. The indictment says he struck the customer multiple times, ultimately breaking his leg.
An FBI investigation of the case is ongoing
Sanjay Patel of the Civil Rights Division’s Criminal Section is the lead prosecutor along with U.S. Attorney Brent Alan Gray of the Northern District of Georgia.
